Welcome to the The Winest platform located at https://winest.store/ (the “Platform”). The Winest Platform shall mean digital platforms and/or applications and/or webpages managed and operated by The Winest Ltd. (private company incorporated in Israel under the registration number: 516460748) registered Lincoln 19, Tel Aviv 5223204 (“The Winest” or “we”, “us”).

The purpose of this Privacy Policy (the “Policy”) is to detail the terms of privacy of the Platform's users and how the Platform uses the information provided by the User (the “User” or “You”). Please carefully read this Policy, including our Terms of Use referenced in this Policy, from time to time, as changes may be made to them, which shall come into effect in accordance with the conditions contained herein.

This Policy is an integral part of our Terms of Use. This Policy is worded in the masculine language for convenience reasons only, but of course refers to women as well.

COLLECTED INFORMATION AND ACCESS TO OUR SERVICES

This Privacy Policy covers any information about users of our Platform that may include personal data as defined by applicable laws and regulations in Israel (the “Personal information”), which we may obtain when you use any of our Platform, websites, programs, products or services, including its search, e-mail, map, storage service or any other program, product or service (jointly referred to as, the “Services”).

We may obtain your Personal information through our partners (the “Partners”), such as advertising partners or service providers, who provide you with access to or let you use the Platform, programs, products or services owned or operated by them, and from the sources of publicly available personal data. Partners may provide us with your Personal information only as stipulated by applicable laws and regulations in Israel and in accordance with special agreements between us and each of the Partners.

The use of some of our Services requires registration and/or the provision of certain information for the purpose of providing digital sales, customer service, delivery service etc. When using our Platform, you will be asked to provide Personal information required for the provision of Services such as:

  • information provided by you when you register (create) a user account, such as your name, mobile phone number, address and age and gender;
  • electronic data (http headers, IP address, cookies, web beacons/pixel tags, browser information, information about your hardware and software, wi-fi network data);
  • date and time of accessing the Platform or Services;
  • information related to your activity while using the Platform or Services (e.g. your search history, data on purchases in the Services, data on visited organizations, likes and preferences, email addresses of your mailing contacts, phonebook data, information about interaction with other users, as well as files and content stored in our systems);
  • your (geo)location information;
  • your payment cards information, and other payment information, provided by you, as well as provided by other entities engaged into processing of the payment operations conducted within the Platform.

Mandatory fields will be explicitly marked.

Without providing the requested data in the mandatory fields, you will not be able to use the Platform services that require consent and/or providing details.

You are not under any legal obligation to provide the information and its delivery depends on your will and consent. If you do not want to provide the information, please do not use the Platform.

We will only keep your Personal information for as long as it is necessary to fulfil the purpose for which it was collected or to comply with legal and regulatory requirements.

ACCURACY OF THE PERSONAL INFORMATION

To the extent that you provide or upload any Personal information to the Platform, you hereby declare that the information you provide and/or update on the Platform is true, reliable and accurate and that you provide the information in your name and for yourself only, or that you are legally authorized to provide this information for another, and in any case, you will be solely responsible for providing this information.

If and to the extent that you provide Personal information of any kind, this information will be kept according to the Israeli law for the purpose of managing and optimizing the service, for operational, marketing, or statistical needs, including the processing of this information for the purpose of realizing these goals as well as for providing service and encouraging the loyalty of the Platform users and ensuring fair trading activity according to law.

It is hereby clarified that, by law, you are not required to provide information on the Platform, and that you provide information at your own risk, on your own free will and with your consent, and you will not have any claim and/or claim against us and its representatives on the matter.

USE OF PERSONAL INFORMATION

We may use the collected Personal information according to this Policy or according to the provisions of Israeli law, for the following purposes:

  • To provide you with access to the Platform and/or the Services;
  • To provide you with access to your user account, including your email and storage service, if you have an account for these services;

  • To offer you other products and services from The Winest or other companies which we think can be of interest to you (i.e. personally-targeted advertising).

We may use information for operational, marketing and statistical purposes, and provide statistical and/or aggregate information that does not identify you personally to third parties for these purposes.

We will only keep your Personal information for as long as it is necessary to fulfil the purpose for which it was collected or to comply with legal and regulatory requirements.

PROVIDING PERSONAL INFORMATION TO THIRD PARTIES

We shall not transfer your details and the information collected about your activity on the Platform to a third party except in the following or similar cases:

  • Upon request or with your express consent or by registering for a certain service which may require this, with your consent;
  • When the transfer of the specific information is necessary to complete a purchase procedure, which was carried out by you from a third party;
  • In the event of a legal dispute between you and The Winest that would require the disclosure of your details;
  • In the event that a judicial order is obtained ordering you to hand over your details or the information about you to a third party;
  • To conduct statistical analyzes and transfer statistical or other information to third parties. Said information will not allow your personal identification;
  • In any case where we believe that the delivery of the information is necessary in order to prevent serious damage to a person's property and/or body, or in order to prevent other serious damage at its sole discretion;
  • In the event that The Winest is sold, transferred and/or merged or where its activities are transferred, in any way, to another corporation, provided that the recipient of the new information will accept the instructions listed in the Policy and will act in accordance with the instructions of the Israeli law;

We may transfer statistical information about the activity of its users, provided that this information does not identify you personally. The transmission of your identifying information to advertisers will only be done by obtaining your approval for this.

COOKIES

Cookies are small text files accepted and processed by the device you use to access our Platform. They contain information that is collected from your device and sent to the Platform on each subsequent visit. Their use helps your navigation through the Platform and allows us to remember your preferences over time.

DATA SECURITY MEASURES

The Platform uses industry-standard measures to secure the content of the user's Personal information and in accordance with customary standards, in order to secure the Platform and the means of communication through it and the information under its control, against accidental or intentional exploitation, loss, destruction or against unauthorized intrusion;

Although these measures reduce the above risks, we cannot absolutely guarantee the security and preservation of the information and do not guarantee that the Platform or its use will be immune to the non-disclosure of the information as a result of unauthorized intrusion into the Platform services, information or content stored therein.

Therefore, it is hereby clarified that we will not be responsible and will not bear any responsibility in case of intrusion or hacking and/or any damage caused due to the use of the Platform and/or the content displayed on it and/or the accompanying services, by the user of the Platform or anyone on his behalf.

UPDATING PERSONAL INFORMATION

According to the Protection of Privacy Law, 5741-1981, you may review your Personal information that is in stored on our Platform database and even ask us to correct this information if it is incorrect, complete or accurate and even delete it in appropriate cases.

In order to exercise this right, a request must be sent to the us through the contact page on the Platform.

GOVERNING LAW

The laws that applying to this Policy are the laws of the State of Israel. The exclusive jurisdiction, in any dispute between the owners of the Platform and the user, arising from this agreement or the use of our services, is given to the competent courts in the city of Tel Aviv-Yafo.
